Paid for Parking, Received Citation Notice in mail (not on car), now owe $65?

I received a Notice of Deliquent Citation (unpaid parking fee) some time in February, which took me by surprise because I had not received a citation on my car. I looked up my BART EZRider account and noticed that I had paid for parking on the date the citation was issued. I wrote a letter to BART showing proof of payment.

In May I realized I hadn't received anything from BART, looked up the citation on the website and found out the citation had not been dismissed and instead had been raised from $35 to $65.

I have called the citation processing center and have been informed that because I "did not timely appeal" the citation there is "nothing" that can be done, nor is there anyone that they can refer me to. I find it absurd that there is "nothing" that can be done for this situation. Clearly, I have proof of payment of the $2 parking fee for the date of the citation and how is it that there is nothing that can be done? Someone please explain how and why I am required to pay $65 for a wrongfully issued citation?

Just don't pay. If they threaten to take you to court, go to court and show the judge you paid, and that there was no note on your car.

Private parking tickets don't go on your license.

The tickets do not go on your license, but they do show up on your vehicle registration when you try to renew it. The fees are added to the registration amount. Also after a certain number of unpaid parking tickets are on file, your vehicle can be towed. Believe me parking tickets stink! I had to pay four separate citations over two years when I forgot to validate on the old Lake Merritt machine. No immunity here! I also had three from the city of Oakland when I ran out of time on the meters. Those were more expensive than BART citations.

Guess I'm wrong then, I know the tickets you get in those private lots in downtown WC don't affect your registration.

I didn't actually intend to say NEVER pay the ticket, just don't pay it until you get it resolved or you're out of luck.

I have been nabbed several

I have been nabbed several times at BART lots as well(WC & PH) and although I was not in the wrong, because there is no way to fight it it was just easier to bite the bullet and pay.

I have a hard time believing

I have a hard time believing that there is "nothing" that can be done. I intend to fight this damn ticket until it's resolved. The irony is that if the ticket had just been $10, I would have paid the damn thing to begin with just so I didn't have to deal with the stupid answers I get when calling the Citation Processing Center. I mean, it's absolutely ridiculous that they would make someone pay $35 for a $2 parking fee in the first place. They would probably get more money if they just lowered the amount to $10 or $15 and then the penalty to $35. I guarantee most people would pay the damn thing just so they don't have to deal with someone reading a script to them.

I have left messages at every BART office I can find. Next step is a letter from my attorney. It's a good thing I work for one and at the same time, pathetic that I'm having to even bother her with it.

the real issue is that BART

the real issue is that BART doesn't control anything after the citation is written, you then are actually fighting a private company that reports to nobody as far as I can tell. They are not incentivised to do anything but deny your appeals and continue charging you a higher fee.

That company just doesn't care. They deny anything because (except for the OP) 99.99% would not spend more money than the ticket to hire an attorney or file legal claims. It would end up costing more than the ticket.

If someone does go that route then the moment that parking company would get a legal paper they'd probably just shrug and say forgive it. It wouldn't matter to them money, and they'd probably laugh that someone spent more to fight it.

I just don't even know how

I just don't even know how this can be legal...when I had my citations I was clearly in the right. I had my copy of my parking validation but even when I submitted it I was told that it was denied. I should have taken the company and BART to small claims court for the amount of time that I had to spend on this issue and make them address this. Maybe fighting it in the media to bring a spotlight would be the best way to get them to forgive this debt?

Oh, I did email 7 on your side, but have not received a response. I guess if they do contact me I will report the process and the fact that the citation was ultimately dismissed....after 6 months!

$65 Citation

$65 Citation Dismissed!!!!!!

I am proud to report that the citation which was issued to car on January 25, 2010 has been dismissed. The process to resolution and JUSTICE:

1. Received Notice of Delinquent Citation, $35. Strange, since I had not received the ticket on my car.
2. Wrote 1 letter disputing the ticket and providing evidence of payment (account history of BART EZ Rider showing deduction.)
3. Three months pass, no word, assume citation is dismissed. Check online, citation is now $65. Write second letter.
4. Receive a second Notice of Delinquent Citation, now $65, which stated appeal was not received within the 21 day appeal time.
5. Call Citation Process Center, spoke to three different representatives, finally a supervisor who left a voicemail stating that there was nothing that could be done and no one else I could speak with. Last conversation I had with a representative at the CPC I stated that their response was unacceptable and I wanted to speak with someone to resolve this issue. I was informed that I had to pay the citation and that there was not a remedy.
6. Wrote Board of Directors at BART, thanks to a reply to my post.
7. Received a response within one day stating that there would be an investigation.
8. Received a phone call the next day from the Mr. Morgan, Police Administrative Supervisor at BART requesting specific documentation.
9. Within an hour of sending Mr. Morgan just two documents 1) the citation and 2) EZ Rider account history, I received a phone call from Mr. Morgan apologizing for the oversight and stating that my citation has been dismissed.

I later received an email stating the following:

"I have investigated the issue with the parking citation you received on 01/25/2010. Our ticket processing center did not receive your first notice of appeal. When they received your second notice of appeal on
05/17/2010 the 21 days plus 14 day grace period in which the appeal needed to be in by had expired. The citation was upheld due to the appeal not being timely. If an appeal is not received within the required 35 days it is not forwarded to the police department for review. Had your appeal been received within the required time frame we would have dismissed it based on your EZ Rider account summary you provided. With the information you have provided it is clear that the citation you received was issued in error. I have dismissed your citation and late fee in the interest of justice. I am also going to inquire with the citation processing center to see why you were not referred to the police department in order to seek a remedy to your situation. We have access to recordings of their phone calls with patrons regarding citations and I will be reviewing your case with them so that we do not have a similar problem arise in the future. As for the citation itself, the Community Service Officer may have not seen the EZ Rider hang tag in the window, or the payment report the officer prints to write this type of citation was printed prior to your arrival. If you should ever get another BART parking citation you are now able to appeal the citation on-line at www.citationprocessingcenter.com . This on-line appeal feature will also allow you to submit supporting documentation such as your EZ rider account balance and other supporting documentation. If you should have any other concerns or issues with parking at BART please feel free to contact me. I appreciate your patronage of our system and hope you continue to use BART for your transportation needs."

I hope this information helps all who have run into a similar unfortunate situation. I understand that citations can be issued in error and I have no problem disputing the citations. Errors happen, we are all human. The problem lies when there is evidence that will not even be considered because "there is nothing that can be done." There is ALWAYS something that can be done, you just have to keep pressing forward and do a bit of research. Without finding this forum I probably would have never written the Board of Directors and who knows how long it would have taken to get the citation dismissed. Thank you again to all who gave advice. Thanks Icrew for your post. It's what led me down the path to victory! Agreed that it is insane that it takes so much energy to get an erroneous ticket dismissed. Hopefully Mr. Morgan will follow through with CPC and advising them to refer people to the BART Police Department, which apparently is what they are supposed to do.
