Carpool Parking Citation

Hi,

Yesterday we forgot to place the carpool parking permit on the dashboard of our car when we parked in the carpool parking lot. By the time we returned in the evening, we found a citation on the front of the car saying we need to pay a fine of $40 for carpool violation.

Is there a way we can appeal just for forgetting to display the permit? we still paid for the parking $1 but don't have the receipt. we have the parking permit numbers issued when we applied for carpool parking.

You can give it a shot, but

You can give it a shot, but it's going to be hard to prove since there's no proof of payment and no proof that you actually qualified as a carpool. If it's your first ticket maybe they'll have mercy, but I wouldn't hold your breath.

I think you have a good chance of getting it dismissed. On the back of the ticket should be an address where you send your appeal (you have about 3 weeks I think). Gather up all your documentation (the permit, proof of purchase, if any, etc.), everything. Write them a letter explaining what happened. I think you have a good shot at getting it dismissed. Good luck.

I tried this exact thing and all I got was an additional penalty for delayed payment. Pay it and move on.

I got a citation last month

I got a citation last month in the Fremont lot for parking in the reserved section. It was my first time parking there and I did so without knowing any difference between that section and the daily parking section. I parked there and paid the usual $1. I got a citation at the end of the day for $40. I appealed the citation stating the facts and that it was an honest mistake - Appeal Denied!!

I then paid for the citation and then emailed my BART Director (different for each region I believe). The email was forwarded to BART Police and I got a first time courtesy dismissal.

Worth a shot trying to get it dismissed. I wish BART was a whole lot simpler though. Sometimes it sux!
