Crazed Preacher
This morning riders at Bayfair were once again subjected to the loud rantings
of a bible-carrying black man walking up and down the platform shouting "Ya-SHO-Ah,
Ya-SHO-Ah is KING!" at the top of his lungs. He got on the Richmond bound train
and continued his bellowings until the train was halted @ 12th st and 2 BART
police entered the car where he was riding. I thought they were going to remove
him but, amazingly, they seemed to know him and were looking for someone else.
This guy has been around for a few months now and works himself up into a lather
as he derides passengers for going to their jobs everyday and worrying about
money, car payments and other material things. Whatever happened to being arrested
for disturbing the peace.
Thank Ya-SHO-Ah he doesn't ride a bicycle.

If he is creating a huge issue on the train / in the paid area ...call him in and be detailed about what exactly he is doing.
Free area fruitvale he is kinda loud but friendly for the most part.

The flip side of freedom of religion is freedom FROM religion. I don't care who he is yelling about but I resent it being done in my ear
and the fact that he disrupts train service. He can worship Bill the Cat for all I care as long as he does it QUIETLY.
I'm no fan of being bothered
I'm no fan of being bothered on the train, but if BART has to allow people with protest signs, and street musicians, and people handing out pamphlets, and guys in guy fawkes masks wearing oscar grant memorial t-shirts on their property, then they have to leave the bible thumpers and the crazies alone too.
The second someone is obstructing flow through the gates, or drunk/high, or aggressive towards someone, or selling something, that's different. Sounds like this guy is just loud.

Here's the deal from officer's point of view: People have a right to express themselves under the First Amendment to the Constitution. They can stand on the corner and preach all day long about politics, religion or whatever without government intrusion so long as they don't trespass on another's property or block the free flow of traffic. Within the BART system this becomes a little more problematic. A person who is blocking access to entrances or exits or who creates a threat to public safety is subject to arrest or citation under 369(i) of the Penal Code. If someone such as the aforementioned preacher is riding trains and preaching out loud, the violation MAY be, Willfully Disturbing Others under 640(c) P.C. The officers, per direction of the Department, are not able to solely make the determination whether the suspect is willfully disturbing the victim. In order to cite, the officer needs the victim to sign a Citizens' Arrest charging the violation. Generally, the patron just wants the officer to "take him away" but does not want to step off the train and get involved with signing a complaint. As you can see, it is a complicated matter and not simply as easy as having an officer take a loud patron away. Believe me, the officers would like to remove a lot of trouble makers we contact on the trains. But misdemeanors or infractions not committed in our presence require a Citizens' Arrest in order for us to charge suspects. Are you willing to step off the train and be delayed 15-20 minutes to sign a form and give a statement?

No, I'm not. After the officers gave this guy a pass, he was
telling the other passengers how he had been twice removed from
the train and detained for mental evaluation in a hospital. About
all I can do is move to another car and hope I'm not around when he
finally spins his donut.

I've been on BART when this guy has been on too. He is REALLY LOUD. Yuck!
